COMMUNITY MEDIATION IN THE FUTURE

Description

The Community Disputes Resolution Act was recently amended to introduce an enhancement to the Community Dispute Mediation Framework (CDMF). The CDMF seeks to promote good relations among neighbours to minimise the occurrence of disputes, and to promote community mediation as the source for helping neighbours to resolve their issues in an amicable manner.

However, not all disputing parties are willing to use mediation to resolve their problems, while there are others who are simply recalcitrant and unwilling to compromise causing disamenity and annoyance to the neighbours.

The enhanced CDMF hopes to address the issues encountered by introducing new initiatives and measures. Among them are making mediation mandatory, and setting up a designated Community Relations Units with a wide range of powers including investigatory and enforcement powers to intervene in neighbour disputes. The role of the Community Disputes Resolution Tribunal (CDRT) is enhanced with greater powers to deal with hoarding problems, people who have mental conditions, and to issue interim orders among others.

This webinar discusses the measures introduced in the enhanced CDMF, and examines how future community mediation will be like. It hopes to provide a better understanding of the Authorities’ efforts in encouraging neighbours to resolve their problems amicably, and failing which to provide the necessary support for resolving the severe and egregious disputes under the new framework.
